I live in NC, and have filed papers through Child Support Enforcement for over a year, and even gave them his current address, but when I call the state he lives in, they say they have nothing on the case! It is now well over $40,000 that is owed. Is there any place else I can try that will not cost me? I'm too strapped to pay legal bills.

there are two ways of handling this amount owed;

1) contact supportkids.com (or another collection agency). yes, they take a % (usually 25-30% of what they are able to collect), but it sure beats nothing.

2) apply some heat to the case;

call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?
--is it an interstate case yet?
--is there a bench warrant out on him yet?
--have they taken any of his licenses (drivers, teaching, etc) away yet? have they applied to do so?

sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, the fact he's now a teacher, and why they have not attached his wages (salary) yet. ask why they have not taken his drivers license, teaching license, etc away yet, ask why these two states are not communicating with each other and why they are not acting on the information you have provided.

ask them what they are doing about it. tell them you respectfully request that all state & federal laws be applied to this case and its outrageous arrears.

then take that ONE letter and FAX it to the following:
a) both states Attorney General (link is below)
b) both states Governor (link is below)
c) both states Child Support Depts (link is below)
d) both states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean. who cares if you miff 'em off? just keep at 'em until this is addressed.

dont take 'no' for an answer. they are supposed to do all that they can, and apply these laws (they are there for a reason) to prevent such huge arrears amounts.

Is your order out of NC? (If so, sorry. Based on my experience one of the worst states to deal with (along with Arizona)).

You need to contact your CSE office (in the state that your divorce/support order is filed) and tell them you want an interstate transmittal (UIFSA) sent to the state in which he resides. You would like it to include current support and a request for collection on all arrears, garnishment of wages, drivers license revocation (if his state does that) and liens on property. Based on the amount past due, and when the last payment was received, he may qualify for Federal Prosecution.

If you do not get action from your local CSE office, you call the state Dept of Family Services (or the state office that oversees CSE) and get a message to the director they are not assisting. If that doesn't work you contact the Attorney General's office who represents the Dept of Family Services, and if still no action call you state Governors office.

if your ex is in another state rather than the original order you're SOL. another state doesnt have to enforce your order. if they do they're just being nice. usually they wont. you may have to file contempt and force the state you have the order to penalize him consisitently for not paying. obtain a judgment and then file the judgment with his employer. that's diff than a c/s order.

Talk to your local state senator. They are very helpful in this regard. Ours helped my sister quite a bit. Sometimes the state agency needs a little kick start to get them going.

If you're not on welfare, the CSE system does not work well. If NC has not sent the paperwork on to the other state, they are the ones you need to go after. your only other choice, ruling out lawyers, is to go to the other state and go after him yourself.

each state has their own child suppot enforcement agency. it looks as though NC has done all they could amd it is up to the state your ex resides in to do something. you have to do the filing in his state as well.
