How long has your dog been eating the berries?? Is she vomiting or showing signs of lethergy? At the moment you should be more worried about whether or not the plant is poisonous than how to remove it. Take samples to a local nursery (not Home Depot or Lowes, they dont know anything)
if it is poisonous, cut it down then use a stump killer to kill the root. If it is not poisonous, leave it, it might be providing important food to birds.

Hints: Are the berries and flowers growing in clusters? They could be elderberries (Sambucus). But that also sounds a bit like Rhaphiolepsis.... you can also try Dave's Garden

The problem with identification in such cases is that a lot of information is needed ,like details of leaves, bark, size of fruit, are they borne singly or bunches, fruiting season etc,the point however is if you feel it is too much trouble dealing with the fruit & your pet, then the only way is to have it cut down,if it tends to reappear ,as happens quite often since the roots are in the soil, then digging up the roots will put an end to this.

This same thing happened to my dog. At first, I thought she
was sick and was going to die. The vet said no, she's not
going to die and suggested I talk to a horticulturist. I took a few cuttings from the "tree" and showed it to him. He laughed
when I asked, but told me not to worry. The "tree" was called
"Oregon Grape", and my dog just needed some of the
nutrients in the berries. Maybe this is the same for you.

If these are berry like and stain your fingers when you squish them, it is likely a mulberry tree, you will have to cut it down to remove it.

Sounds like a young flowering plum but without a picture I'm not sure!

Possibly crab-apple. Depends on what you mean by small berries. How small?
