Any help would be great. I have a friend who doesnt have internet access at the moment. He is paying an outrageous amount for child support. I have heard of people filing a hardship to get the amount reduced (he's not trying to duck out of child support so please no nastygrams!) If this is possible how does one go about it?

for the morons that made reference to how much he is paying you don't know the details he's paying way more than any of you guessed, his wife doesnt work and does not want to work, he is also making a 600 a month vehicle payment on a vehicle that he didnt even have his name on in the first place. Get your facts straight before you judge.

he needs to go down to the court for child support services and file for an OSC Modification hearing for child support. he needs to provide proof that he cannot pay the court agreed upon amount. such as additional dependants, reduced wages at work (last two paychecks) serve all parties involved, such as the DA's office, the custodial parent and any attorney involved.

there's a reason for the c/s calculation. was he not there when the court was determining this? he could and probably did claim hardship then. noone sits there and says ok if they cant pay it. why would he be paying on a vehicle THAT much if he doesnt have it? sounds like he needs to handle his real financial situation before robbing his child from a healthy well-being life.

actually CA has lower c/s than other states. he should be happy he doesnt live in another state!

first of all, no child support is outrageous.

he pays what? 400? 600? 900?

ok, lets see...
rent; 1000
electric 300
food 400-600
diapers 75-150 per month (fluctuates when baby is sick or teething)
heat 300
phone/cable 100
auto; (for doctors, dentists, take to school when they miss the bus, pick up when sick, pick up medicines, get food) 200
clothing/shoes/boots 200-400 every 2 to 3 months (seasonal and they grow)

that doesnt even include dental, doctors, glasses, daycare, hair cuts, school supplies, school lunches, school projects, class trips, class pictures, over the counter medicines, prescriptions, laundry det, dish det, cleaners, soap, shampoo, toothpaste, christmas, easter, halloween, tooth fairy, birthdays, etc. and sooo much more.

in my house, the children go through 1 gallon of milk per day; thats $3.60x30... almost $100 a month in milk alone. and thats JUST milk.

its hard on everyone; him, the ex, the kids. but we all do the best we can. he can get a roomate, second job (just to pay the support), ditch an auto payment or what ever he needs to. he can try and request a hearing from his caseworker, but it wont be lowered unless there is a change in income.

All he has to do is go down to the courthouse and fill out the necessary paperwork for the judge to look at his income and re-assess the child support order.

He can ask 4 despite he needs yet would not advise he gets it.i could think of he could could pay lower back the arrears first till now getting something like that if he did.I advise he's on incapacity now yet what replaced into excuse for the final previous 12 years.it is how the courts will seem at it.

He might want to consider getting a second job. They are not going to reduce child support. He is the parent and it is his responsibility to take care of his kid.

Bet he didn't think about all this when he unzipped, did he?

he might see the judge that set it, but i would guess if is at the same income when it was set it needs to get paid
