Hy husband, who is currently stationed in Germany, and I are going through a divorce. My husband now has a new girlfriend (has had for a long time now) who apparently has a "problem" with him having a child. He has expressed interest to me in signing away his rights to his daughter. He says that it is "too much to bear" being so far away from our little girl and that he would "never get to see her anyway". By the way, that is code for "I want to be 22 without a kid and without a child support payment". It this even possible anymore? The literature that I have read on the subject suggests that this is only an option if there is another party ready to adopt, ie if I were to remarry. I am currently single, struggling to make ends meet. Can he do this to us, can he simply sign away his rights and leave us with nothing?

no your husband can not simply sign away his parental rights just to avoid paying child support. signing away of parental rights requires both partners to agree. you should see an attorney or try and get help from a legal aid worker where you live. best of luck

Nope, he can't. Especially since he's military. Get in touch with his payroll officer or military command if he's not sending child support payments now. If you don't know who/where to contact, find the nearest base for the branch of the military he serves in, they should be able to assist you. Believe me...they will make sure that you are getting what you need. Make sure you ask for child support and dependent medical care in your divorce petition as well. You need to also put in a clause concerning your child's college education/future as well. The only way a parent can sign away rights is if the minor child was going to be adopted by another family or if you were to remarry and your new husband wanted to adopt her and assume all the parental responsibilities. Even if you do remarry, don't let that dog dump his responsibility to your child.

I know that in KS,Mo and TX you cant give right away unless the court takes them away for drugs, felany, or something to that sort. And yes they can give up rights if there is another parent to take there place if all party agree.

Yes he can if he wants to. This is his choice. He should love his child more then her and he should dump her but like i said this is his choice. Sad part is your child will hate him for this later and resent him. You just need to be the best mom you can be and hopefully someday you will find a wonderful man who will love him as his own and be the best dad he could ever have.
