My ex wife will not drop off the kids when it's her weekend to do so. Our agreement states that we will both contribute to transporting the kids on my weekend. What option do I have? If she doesn't drop them off, can she be held in contempt for not bringing the kids to me. When it's my turn, I'm happy to go get them and bring them back. I'm tired of being walked on. What options to I have?

I live over an hour away. The problem is that on Friday's it takes almost 3 hours round trip. That's why we switch. On Sunday's it's half the time.

If it is a court order that she brings them to you, then yes she is in contempt . Talk to your lawyer and he might just send her or her lawyer a reminder. If this does not work take her back to court. Good luck to you

If it's in writing, then, yes, she can be held in contempt for it. But I guess it's up to you. Would you rather spend the extra gas or go through all that paperwork? As long as you still get to see your kids like you're supposed to, I wouldn't make such a big deal about it.

Just went through that. Go to your police dept and file a complaint. Bring your paperwork w/you to the PD they will file the report, give you a copy and send it to the court. They will keep it on file. Keep a log of all events, you can submit these in court at your next OSC modification or hearing. If she continues to do its then go through Mediation. Good luck!

Have your lawyer contact the court that issued your divorce to enforce the custody clause of the decree. If enough complaints are turned in, you might get a new custody hearing in which your ex loses her parental rights. Do not do anything else or you may be the one who loses parental rights.

I had a similar problem and unless she goes along with the Divorce Decree, the only option you may have is taking her back to court to have that part enforced. But make sure you ask yourself if it is really worth all the trouble and aggravation.

Yes you do have the right to take her to court over this. That said make sure you are following the letter of the agreement yourself or you could damage your case.

If you are getting to see your kids unhampered then let it go and pick your kids up with a huge smile on your face, especially if it is a reasonable distance.... The kids will be happy that your happy and your ex will wonder what your up to.

your options are at least in Arizona is to take her to court arbitrator who can discuss the options after listening to you, the options available to both of you, this is the easiest step, if the arbitrator doesnt like your wife, or what they see they can tell the judge that you all need to go in front of them,

Yes. If she doesnt go by the agreement, then she can. Warn her about that. And tell her that if she doesn't start acting on the agreement, then there will be consequences.
