There is no agreement now and the kids are 3 and 7.

Aside from the obvious. time, days everyother weekend, holidays, birthdays etc we also arranged who will feed the kids. Sounds stupid I know. He would bring the kids home at 7pm on a school night and they would be starving. So, I had to put that he feeds them before he brings them home and I feed them before they leave. The little things like, if its his day and its a school day & there is a permission slip that goes home, it needs to be discussed with you. My son went on a class trip & I was never told. I would also pack the kids clothes and they never made it home, so I put that he had to get them clothes for his house or sign something saying all clothes would make it back. Again, sounds stupid, but I just couldnt afford new outfits everyother week!! Maybe your ex isnt a jerk like mine was. Maybe he wont use the kids to get back at you like mine did. Good luck

There is typically a standard custody agreement, and it is good to have. While things may be good for a while and you may use your own schedule, at some point the standard issue will be good to have as a strict guideline. This schedule seems to work for everyone. Things you may want to include:
* No one (adult) of the opposite sex is allowed to be in the presence of the child after, say, 10pm until married (bf's and gf's can't sleep over when the child is there)
* Custodial parent cannot move the child out of the state unless permission by the other parent is given

Things like this are important for the child's sake.

Holidays are a must, as well as specifying drop off and pick up times. Don't be afraid to be tedious about what you put in, tedious will pay off in the long run. You may not be fighting now, but nothing specified in the custody agreement about the details can cause fights later.

Custody Agreements are usually already formatted so there is no room for question or doubt. The only thing you need to decide is what type of cutody. In the county I live in there are clear stipulations and no room for error. I would make sure you don't leave anything out of the divorce papers if you are also divorcing.

What is in your custody agreement now? Is it joint custody are you and the other parent on good terms? Need more info to help

address who covers what expenses

address holiday visitation & regular visitation

address who gets to claim the kids on taxes

I thing you should file and clain income tax on one of them each year
ask.......thats a nice way to do it I think
