My husband and I were married in Pennsylvania, but lived in md while we were together for the brief 6 months that the marriage actually lasted. He's now moving to New York, and I'm still living in MD. Which state's divorce laws do we go by?

wherever you file...since you are in MD, you can file there.

I know MD requires a 1 year "separation" before they'll grant a divorce though. New York might be quicker. I'm told MD has some of the more restrictive regs on divorce.

It is where both of you want to decide on. You can get a lawyer to provide an injunction in MD for divorce, if your husband concedes that is where the divorce will take place.

maryland, as soon as you establish permanent residency which is "a 1 year requirement if the grounds for the divorce occurred outside the state of Maryland, otherwise if either spouse is a resident of the state of Maryland, he or she may file in the county in which either spouse resides."

unless grounds for divorce occurring outside of maryland means that the marriage occurred outside of maryland, in which case you will have to go back to pa.

talk to a lawyer.
