I sold an item on ebay and sent it to the winning bidder, they paid through paypal and then filed a dispute that i had not sent it. When they recieved it they then said they did not want it and would send it back. I never recieved it and i have a proof of posting but not a tracking number which they said they require and paypal voted the dispute in their favour, now they have the item and my money, what can i do?

is their a way if i win that i can make the buyer pay for my court fees and also sue them because i was unable to buy and sell on ebay for over a month as paypal blocked access until the dispute was over.

There is always small claims court, but depending on how much the item is worth, you may end up paying more for the filing fee than what the item is worth. Another problem is jurisdiction. If you live in a different state and the other lives in California, your probably gonna have to file it in Cali, which means you have to travel there for the small claims hearing. Is it worth all of that?? Some times you just have to chalk one of as a good lesson for the future.

You would have to go through the small claims court. Ring your local court for information or citizens advice.
