I think the baby should be given up for adoption. The woman should have no rights what so ever from this point on in regards to the child. The doctor should refund her money she paid. That is all.

She should give the baby up for adoption. She didn't want the baby in the first place. She is seeing dollars signs and that is the ONLY reason she stilll has that child. The abortion clinic should refund her money, but they don't owe her anything else. She is the one who got pregnant in the first place. If she couldn't afford to have a baby like she is claiming, then she should have taken the proper precautions not to get pregnant.

So she goes 2 years before deciding to sue? This poor little girl that was unwanted...I think this woman is after the money. She has had 2 years to find a loving home for this little girl and hasn't tried that. The legacy that this child will have. SOMEONE wanted her to live and I believe that she will have a great future.

She has a legal right to keep her baby. Her attempted abortion cannot construe her killing a born baby. Despite failed abortion, she cannot get anything from doctors, yet is at liberty to file compensation & damages cases, since the burden of proving the doctor's fault, deficiency in service, incompetence and negligence is upon her, which she may discharge normally.

Right or wrong aside....aborting a fetus is not the same as killing a child.
If she cannot afford the child she should place it for adoption.
If she cannot bear to lose her child she should consider the failed abortion a miracle and bear the costs of raising her child.
At most the doctors should be responsible for her bills related to the attempted abortion, prenatal care and birth.

If you took measures against anyone who might concievably commit a crime before they did it, we would all be in jail. And let's face it - this woman has committed no crime yet, much as you'd like to think she did.
Frankly, I find your desire to control her body and her baby to be a little loathsome. Do you honestly believe you know so much about living the good life that you can impose your will on everyone around you?
And you show no concern about the bungling of supposed medical professionals. How many other operations have these guys botched? Would you want them assisting you in any way?
Spend less time taking over the world and more time mastering your own imagined fears, and we'll all probably be a little happier.

She is a sick and twisted woman. Has she ever heard of Adoption. If you can't afford a baby, close your legs!!!!! Or make your man wear a condom. If she had been raped, it would have been a different picture. They are NOT liable and she should not have that child. Think of the damage she is going to do to that poor baby. You already know, the child is going to find out about this story and be SERIOUSLY hurt by it!

Legal questions aside, I think she is probably the most selfish person I have ever heard of. Selfish for wanting to kill her baby in the first place and selfish for suing the doctor for the lifelong care and feeding of it. She has totally overlooking the blessing that she has in her daughter.
Poor kid.

how bad would you feel if you found out that you were a failed abortion. that sucks! i don't understand why she kept it! put it up for adoption. perhaps she realized that she could leach more money out of someone by suing them. hooray for our fantastic legal system.oh, and hooray for planned parenthood.
