You must file jointly and if she doesnt sign get an order for her to sign! She has to!

When I was going through my divorce, I did not have to file jointly. The tax preparer told me to file single, head of household. Maybe you should talk to a local tax preparer and see if it is necessary that she signs and you file jointly.

Only if a spouse dies during the tax year, can you legally sign a joint return, and when you sign, her signature (in your handwriting) must be preceeded by the word "By"

Since she refuses to sign anything, consult a tax accountant.
Or, H&R Block could advise you as to the best course of action.

If you were separated at least 6 months in 2006, you can file head of household (if there are kids). Otherwise, file married separately. Although there is an obvious benefit to the joint return, the lack of needing to talk more than necessary, power struggles and mind games were enough for me during my divorce to file by myself.

yes for filing joint you will need her signature. I think you can file married but separate. She does not need to sign as long as you have her social. Just divorced last summer the best feeling ever.

If you are going through a divorce, you do married filing separately... that way your return is yours and hers is hers.... I had to do it when I was divorcing my ex.....otherwise, if you want to do it jointly, she HAS to sign or give you a power of attorney to sign for her

You can submit the return without your spouse's signature but it wont be processed.

Nope you definitly need her signature or you cannot file jointly at all. Ask her again to please sign and if she refuses contact and attorney about it and see if they can help you at all with it. Good luck.

as far as my knowledge is... im married but legally seperated.. so you should be filing as head of household. i never got any trouble with it and i always filied through h and r block

No, that's forgery. Why not file married filing separetely, it worked fine for us.
