My boyfriend just recently moved to Florida from New Jersey. He is trying to get a job, but he is having a hard time doing it because he has a pretty bad record. He has been in jail several times and did time in prison. He is now trying to straighten out his life and make something of himself, as he is only 28. He is reformed.
Is it really legal for a business to deny him an oppertunity because he has this record? If so, why?

Yes, it is legal.

Discrimination laws only dictate that businesses cannot discriminate because of race, age, sex, and veteran status.

I recommend that your boyfriend go back to school. Completing a degree of some sort will indicate to prospective employers that he is serious about turning his life around.

Companies cannot discriminate but they don't have to hire him either. Depending on his past criminal history makes it very hard to get hired. If he has felonies it is even harder. Tell him to keep the faith, eventually someone will give him a chance. It will just take time. If not, maybe he should think of getting his own business going if there is something he has always been interested in doing. That's what alot of men do that have served time and find it hard on the outside because no one will give them a chance.

maybe it's not legal but who say's the business has to take the risk. 90% of the crime is done by 10% of criminals. A repeate offender with a bad record fits in this categotry. I wouldn't hire him either.

My suggestion, hire into a smaller business, one that isn't going to go through the trouble of a criminal investigation, especially one out of state; lie on the resume if and when they find out they will fire him but he would have earned the money during that time. A legal name change may also make the company search to tie him to his record harder.

If he is full of jail house tats, the tear under the eye, love hate on the knuckle, it's over; the only place you can work is construction.

i wonder the same thing! my (22 yr old) husband has one misdimeanor offense on his record from when he was 18, and has been turned down for jobs because of it--and even LAUGHED at for applying in one case (for a position pumping gas even!). in any case, it isn't fair! how is he supposed to get back on track if he can't get a job? i'm just glad i have a good job and we can get by on what i make

yes here in Florida the majority of employers perform background checks and drug testing. because many of their vendors or suppliers or customers require it. your boyfriend needs to work in a field where these requirements are not required (construction) and such. he needs to also try to get his record cleaned up back where you moved away from. if both of you think this is going to be easy it isn't, committing a crime is easy getting yourself straight is not. i hope you both do not get discouraged and work on it.

Yes... but it depends on the crime... Such as if it was embezzlement he should not try to get a job as a CPA. It may be best for him to get a lower position and work it for a year (to show himself and others) and then apply for better jobs.
