Penal Code section 647, subd. (a), "lewd conduct," is a misdemeanor punishable by up to six months in jail. However, usually a first offense is punished by probation and a fine. If the defendant has no other problems, most attorneys would try to negotiate a plea to some less offensive seeming crime.
