A woman is sueing Planned Parenthood and two doctors for the cost of raising her daughter after termination failed.Your thoughts on this topic?If you agree with her, do you think we should be able to sue drug companies for unintended pregnancy while on the pill?

Said child is now two years old.I agree that she should have chosen adoption if she couldn't afford to raise her.I have never had an abortion and even i know that termination can fail.

There are a few things I don't understand...

What year was this going on? under what circumstances does the termination fail? Why didn't she go to the hospital afterwards to complete the procedure? If she didn't want the child to begin with, why didn't she then put her up for adoption?

A couple of other thoughts:

I believe that if she willingly undertook a medical procedure - whatever it may - be you are responsible for understanding the possible effects - unless it was complete negligence on the part of the doctors.

As a mom I would say that a woman is responsible for the child from the moment she puts herself in a position to conceive one.

This country is too sue-happy.

PEOPLE NEED TO START TAKING RESPONSIBILITY FOR THEMSELVES! STOP PASSING THE BUCK!!!!!

No, I dont agree with her lawsuit. People are so stupid and will do anything for a buck. She stated she sought the aboriton for financial reason, well, if she couldnt afford the kid, there was always the adoption option. But IT WAS HER CHOICE TO KEEP THE BABY AFTER THE DELIVERY, NOT THE DOCTORS. So, at most, maybe sue for delivery costs. I mean, jeez, if she was willing to kill the baby, surely it wouldnt have been a big deal to give it away. She wants an easy buck. And no, people should not be able to sue for unintended pregnancy while on the pill, the pill does not give a 100% guarentee it is effective, it gives 99.9%, or something like that, so a lawsuit would never even see a trial date.

Legally I think she has the right to an abortion. I personally don't agree with it, but it isn't my life, so there you go. As far as sueing for the costs of raising her daughter, I don't think her case has any merit. The reason that I say that is even though the abortion didn't work, that doesn't mean that SHE has to raise the child, and probably shouldn't. There are alot of people out there that have trouble conceiving and they would love the opportunity to raise a child, sometimes adoption is there only way. If she doesn't want to spend the money or the time, she should put her up for adoption and give her daughter the opportunity to have a good life. Well, that's my opinion anyway.

This a a tough question. I am pro-choice but in this case I do not think she should sue. I image that knowing her mother tried to abort her and then sued the clinic because she survived would be very traumatizing for this child. She needs to place the child up for adoption if she does not want to raise her, don't raise her and subject her to the trauma of knowing how unwanted she was. That is cruel. This is the exact reason I am pro-choice this woman does not know how to be a self-less mother. She has this child who she is going to mess up for life by pursuing this lawsuit while keeping this child, put that child up for adoption and the sue if you want to. This is a no brainier, this woman should not be a mother.

If there was a guarantee that the abortion would be 100% effective, then I guess she does have the right to sue them, and will probably, unfortunately, win the case. So sueing the birth control company wolud not work because there is no guarantee that you will not get pregnant.

All I know is that every women has the right to do what she feels is right for her. And if that is an abortion, so be it. An abortion is a guarantee that you no longer will be pregnant. She must have went home thinking she was no longer pregnant. So yes I think she has the right to sue. The doctor must have known the abortion was not complete.

She actually had the guts to sue? Unbelievable. I guess adoption never entered her small little mind. It's wrong and I hope that she looses. That poor kid. I can only imagine what it would be like to have a mom who didn't want me. How dare she blame others. Maybe next time she should keep her legs closed.

If this is true- what a horrible, evil woman this is. How dare she put an innocent child through that!!

She should have immediately put the child up for adoption when it was born. That little child could have gone to a loving couple who couldn't have natural children of their own AND her medical expenses could've been paid by the adopting couple.

What a nasty example of humanity-what an ugly sl*t who should get herself sterilized or learn to keep her legs closed. She can do what she wants with her life, but she has no right to ruin her kid's life.

If this is how people show their regard for life, we're in trouble big time.

Drug companies cannot be made liable if their drug proved successful for others. They may take a defense that their drug was not used properly or not at all used. However doctors can be sued for their fault, defiency in service, incompetence, negligence etc. The burden of proving lies on the person suing.

I personally am against abortion. Not for any religious reasons, but because the greatest document in the land (the constitution) says that everyone has the right to life, liberty and the pursuit of happiness. I believe that life starts at conception. There for abortion takes away the rights granted all of us. I do not believe that she will win her law suit. The drug companies can't really be sued because they put on the prescription that it is only 98% or whatever effective. That frees them from liability.
