I got drunk one night at a 'friends' house. I had been over there before, and this guy I know had made it seem like we were just friends and he would look out for me. The next morning, I wake up in his bed(where I had passed out before and nothing had happened), and seems like he had had sex with me. I remember crying at some point, but can't remember anything else. Is this rape? Now I hear he has a history of this type of thing. I don't remember giving consent and never would have, I wasn't interested in him like that. It has been over a month. If it is rape, is there anything I can do? I already know I am stupid for putting myself in that situation, but I need advice. Can I press charges, will they stick?

Legally yes it is rape. Anytime someone has sexual relations with someone else against their will or if they are incapacitated and cannot give informed consent, that is rape. Can you press charges? Yes, you probably can but you will have to go through a lot of crap for it. If it's true that he has a history, can you find any of his other victims? If there are many of you, the charges are more likely to stick. But in the future, don't drink so much. You're destroying your liver, putting your life in danger, and what if you had ended up pregnant?

As you say you now find out his has a history of this, you could go to the police and tell them your story and if other women have come forward it might help them build that case, or might help them build a case for the next victim, but I don't see any charges sticking in this case.

At best, even if he admits that you have sex, he will likely claim it was consensual, you slept in his bed before, and that his capacity was diminshed also because he had been drinking...at worst, it would be sexual miconduct, not rape.

If you did press charges i dont think they would do any thing as you was drunk so there for you are not sure so he has a better change of getting off with it i think it id half and half with the rape but as you was drunk you dont really know and no one else will but him sorry gd luck and next time be more careful ok x best answer plz x

I mean you say SEEMS like he had sex with you....ya see are you sure he went all the way? man guys are just pigs. You gotta have proof etc. Did you go to see a doctor yet?

Alcohol makes people do very stupid things at times....things a person would normally not do. You wouldn't still be in his bed if you hadn't consented.

i'm not really sure the same thing kinda happend to me on my 20th bday.. um it was my first time.. and i dont' really remember much of anything at all about it..

um.. i didn't end up doing anythign as i didn't see a point..
