My sister asked for a raise because she was not able to keep up her expenses and knowing the male co-workers getting more pay for the same job. With less experience and time on the job. The employer asked if she was married. He put it this way....aren't you married? She is not, but was horrified by the question. Does she have any legal rights with this question being asked? She got the raise but feels humiliated by being questioned this way.

Talk to HR and let them know that the implication was that if she was married, she should make less money/not get a raise. Employers are not allowed to ask about marital status, children, sexual orientation, and a few other things on job applications, so I assume it would be similar once you work for them.

You can't sue because an employer asks an illegal question. However, what she should have done was politely point out that her marital status has absolutely no bearing on whether or not she deserves a raise.

i imagine as we talk in this u . s . and abroad, marriage & having babies is a scary proposition even if you stay jointly or no longer. right this moment, the divorce price is so severe using no-fault divorce. once you've babies, for females individuals - meaning they carry each and each of the playing cards. a guy right this moment has to understand that, love and "the dream" aside, the risks to adult males/fathers some distance outweigh the rewards. verify the source - some large books and different aspects on only this issue. family members courtroom is tilted heavily in want of girls individuals/moms. moms have each and each of the rights, get each and each of the advantages, and dad is only too usually relegated to a shopper in his youngster's lives even as being an ATM gadget for mom. He can lose 1/2 (or more suitable) of the money, autos, living house, investments, etc... and worse - the youngsters. heavily, if I had familiar then what i understand now about how the divorce gadget sucks in fathers, grinds them up, and spits them out so unceremoniously, i could have in no way gotten married. i could have given up my dream of having a family members. without-fault divorce (the biggest killer of marriage and households) you do not desire an excuse anymore to break up. you only do not could experience like being married anymore - and with that reality comes the reality - a wedding ceremony is now no longer a freelance, so what's the point except to placed your self and your destiny in threat even as someone "would not experience like it anymore?" With women individuals (who've babies) starting up rather a lot 3/4 of divorces right this moment (maximum adult males do not even see it coming), it truly is the smart guy who chooses now to not get married and easily no longer have babies... and that is a shame. This impacts adult males, women individuals, and babies alike. It impacts easily everyone and individuals favor to awaken to that reality. i understand that there are awful adult males and awful fathers in this global - yet make no mistake - the are quite some awful women individuals and awful moms in this global and we could continuously all be treated an identical way (reliable or undesirable) and that only isn't taking position right this moment. Why smash something it truly is operating?

Sounds like I would be getting my raise or I would go to whoever is above the employer.

Her marital status should not be questioned, it's none of the company's business. She needs to complain to HR.
