Smoking In prisons will still be allowed.

According to the draft legislation:

"3 Exemptions
(a) premises where a person has his home, or is living whether
- permanently or temporarily (including hotels, care homes and prisons and other places where a person may be detained)"

Prisons will be exempt from the ban.

As a side note - seeing as "Nearly 200 prisoners and former inmates forced to stop taking drugs by going "cold turkey" are to receive payments." (BBC News) due to a breach of human rights by denying them heroin, we are unlikely to see the banning of smoking in prison!

I know there are some prisons in the states that have no smoking. Those prisoners going through withdrawal must be terrible to look after.

I believe that if smoking has not been banned in prisons then it should be. People can't smoke inside their office building, in some restaurants and in certain places. These are the people who are NOT incarcerated. Those who are incarcerated shouldn't have more benefits. I'm a non-smoker and even I see the folly.

the only place smoking that should be allowed in prison is atop old smokie. let them have their smokes, they can get cancer the same as anyone else.

No, because apparently it would be against there human rights to refuse them to smoke!! I don't smoke but don't you think it is hypocritical?
