I recently took my 7 yr old son to our local dollar store to get a cartoon on dvd. The store was very busy so I rushed him a bit to choose one. He picked one that looked really cool by the cover. When we got home the first scene was of naked anime women. I immediatly looked on the case of the dvd. In very small type it did say nudity --my question is can I hold my dollar store liable for putting cartoons containing nudity on the same shelf with disney and pokemon cartoons. I do realize i should have checked the box over more carefully, but I never thought of nudity in cartoons like that. Please help me with this matter.

I do not plan to sue the store but I will report to them in case there are more cartoons like this one

Something you have to know is that with many stores like Wal-Mart, K-mart, or in your case, the dollar store, they don't separate the anime from the cartoons. In Japan, Anime is a source of entertainment for ALL ages. Genres run the gamet from cutesy childrens material to very graphic material(violence, blood/gore, sex) and everything in between. Basically, Anime is not just aimed strictly towards children in Japan, and most US retail companies don't understand this, so they see animation and automatically assume it's ok to lump it in with childrens cartoons. i'm sorry you had to go through the experience you did just because ppl dont understand that anime and cartoons are vastly different sometimes; it's a war that i've been fighting for many years. my advice is to check the label before buying from now on.

You can't hold them liable. Who ever put that cartoon with nudity with the rest of the cartoons most likely didn't know. You didn't know such cartoons existed, how would the cashier at the dollar store know? Something like that is not as obvious as sticking a Penthouse or Playboy magazine with a bunch of other kid magazines. And you can't prove who put that adult cartoon with the kid cartoons anyway. The point is, this was most likely all an accident and not intentional.
This happened at a book store I worked in while I was in college. The store was trying to get rid of old issues of comic books, so they were bundling them in three's at a discounted price. Well someone accidently put an issue of Sachs and Violense #1 with some kid comics. it contained nudity and the parent who bought it for their kid was not happy. But no one would have known what this comic contains unless they were familar with the comic.
Since you have a problem with the cartoon you bought, and with a good reason, the store should give you a refund on it. But if you are asking if they are liable so that you can sue the store, that's going too far.
As for being in a dollar store. You get what you pay for. Don't expect high quality mechandise or expert and knowledgable employees working there.

Unfortunetly, you can't hold the store liable because it says on the package that the DVD contained nudity. It's your job as a buyer and a parent to check labels to find things that may or may not be appropriate for your son. Even if it was next to Disney and Pokemon and other cartoons, you still should have checked the label, and that is what the store will say. Plus it's a dollar store so they are nto as careful as other stores with grouping things together so I'm nost surprised that DVD was with the Disney DVDs

Dollar stores don't seems to care about to much. If you ask they might exchange it for you. They are probably going to say what do you expect for a dollar. I find the people in these store to be the least friendly in retail. Apparently A dollar doesn't buy you good help either.

Just take it back and file a complaint. Please don't sue them for emotional distress.
While this is not a good situation for you to have gone through, I have to ask. Does your son have a PS2, or X-Box where he kills people in violent ways?
The reason I ask is that Americans are so afraid of sex that a nipple appearing on TV for .5 seconds becomes national news for weeks and yet people are tortured to death and raped and mutilated on just about every primetime show and no one makes a fuss... anyway, sorry to digress but I'm off to the dollar store now.

I would suggest calling and getting the number to the national headquarters. They may not be aware of the situation, or it may be just that one store. At the very least I would make a report to your local better business bureau.

The manager or the minimum wage stocker probably has no idea. You should report it to the store manager so that they can remove it from the shelf.

It is a free country. Both for you, AND the Dollar Store owners.
