July/Aug. '06 answered discovery questions for the Deposition that's scheduled for 12/27. Appointment w/ attorney in Oct. to go over answers, sign papers and discuss whatever questions we had. Dec. comes along haven't heard back from attorney with answers to our questions or follow up appt. to prepare for depostions. I call him the week of 15th. Get appt. scheduled. Meet and find that he didn't submit our discovery questions/answers to other side yet and we still need copies of reports. They cancelled depos. because of it. No biggie. The attorney told me he'd send a letter to us letting us know what we needed for the file, and also answer our questions. Deposition rescheduled for 4/9. I haven't heard anything since Dec. I called 2/27 left message saying I needed to hear from him. Still haven't. Do I cancel the appointment? We aren't prepared again. It's not like I can just go to his office. He's in another state 2 hrs. from me. Advice??

If you have already paid him with a retainer, then you need to let him know that you are not going to accept him not responding to you and that you will be contacting his state's bar association by a specified date. If you are paying him by the hour, then do not pay him any more and let him know that you are retaining a different attorney and that he must send all of your files to the new attorney.

I would fire him and get another attorney. I've always had good luck with attorney's that have their own practice and are fresh out of law school. Although they don't have much experience, your case might be just about the only case they have and they will work very hard on it.

Tell him if he does not return your call by a certain date/time that he will no longer be your attorney. I guarantee he will call you back. But as a side note, I would drop him anyway because he obviously has more important things to do than deal with your case. Fire him.

You obviously can't talk to the lawyer, so file a complaint with the local bar association. That usually gets their attention!

I'd threaten to get a new attorney, there is no way he should be representing anyone -- he doesn't seem to care really at all.

Tell him that if he doesnt start representing you properly, you will go to the local bar association. (big whop I know, but the ABA can be a pain in the butt, so I doubt he will want to deal with them).
