to thosewho made smart *** remarks thanks but im not even married this question is not about me, i guess one needs to specify everytime they ask a question before people take it upon themselves and be rude. everyone else who offered sensible advice thanks so much, i was having this discussion with someone who is currently filing for divorce and wanted to know what generally happens b/c this is her situation.

I have been through something similar. When I split my husband signed the house over, 1 year later when I put it up for sale my ex-hubby and his fiance found out how much it was up for and he started kicking off. I had already applied for the divorce and wanted everything tied up at the same time. I ended up having to clear his half of a joint loan, surrender my half of our endowment policy and in August this year I have to make a final payment of £2,500, this was so I could keep my daughter's home, she's 5 and was 3 at the time.

Its tough it really is, do you have children invovled?? If yes you can not be made to leave the family home your husband will have to leave, the thing there is that if you chose to sell up and move you will have to pay him and if you ever find peace and meet someone else and they move in or you re-marry you would have to pay him out then too.

You need a good lawyer, not sure what part of the world you are in UK matrimonial law maybe different than in the states for example.

Once the house has been given to one party, the other person usually has to be out of the house within a cartain number of hours, usually not days or weeks. Also when the house is sold, the person who was given the house rights by the court gets to keep the money. It does not get split.

When I got divorced, I sold the house and split the equity with my husband. When my (now) husband got divorced, his wife had to have an appraisal, and then give him half of what the equity was in the house even though she was keeping it. So, it just depends. Your lawyer can advise the best route to take, or you and your husband can decide between yourselves.

There are several ways to work this out.....keep in mind that you are entitled to 1/2 of the marital assets...one party can give up their rights to the home in exchange equal things of value. The home can be sould as part of the divorce and proceeds split. As an example in my divorce I gave up the house in exchange for keeping all my pension benefits.

i was given no time to vacate..i lost all my furniture and the only thing i got was the clothes i owned and the telephone she did not want..i left her the car and house/furniture..etc etc

i still have bitter feelings as she took everything..my only last laugh is she had to raise the three kids..two were mine and she had five or six bad marriages after that..spent time in the nut houses and is an alcoholic druggie loser..and sorry to say most of her kids and mine followed her steps..but such is life..
Your best revenge is to do nothing to them..and to live well..living well is the best revenge you can have over these losers.
