I live in Florida, my ex lived in Ohio with our kids, in August I filed papers to get custody of the children. One hearing was in Feb. but he didnt show up. I found out he had a warrant for his arrest for probabtion violation. He has recently packed up the kids and moved to washington, is there something I can do to get the kids back in OHio until the final decision is made?

this all depends on if he has full custody of the children. if he does it will be a little harder and costly to get them back in ohio. if he doesnt then all you have to do is report the children as abuducted. in the case of him having full custody you would need to prove that he is a threat to the children to get temporary custody there really is no other way unless you get your lawyer to have it court ordered that the children remain in ohio upon the final decision.

It depends on what type of custody you have. Like if he has soul custody, or who has physical custody (which person the kids live with) and what type of legal custody you have. For example, I have full physical custody of my child, but joint legal. So my kid always will live with me, but I have to get his approval for major decisions. It also depends on the state regulations. Like, here in MI, I have full physical custody, but according to state law I'm not allowed to move more then 200 miles away without court approval first because I dont have soul custody. You need to find out what type of laws Ohio has in regards to him needing permission to up and take the kids to another state. But, if he has soul custody (full physical and legal) sorry to say but you're pretty much SOL. He can move anywhere he wants, anytime. So definitely check into Ohio's laws and what type of custody you guys have going on. From there you'll know what to do. You could also check in with his probation officer if he has one. If he's still on probation, up and moving to Washington has got to be a huge probation violation there. In which case the WA police might pick him up and send him back to Ohio. HTH!

Ohio should have jurisdiction over the children for 6 months if there was an open custody order. Call the gardian at lidem.

yes find out what state the violation is in and go to court
tell them he is wanted and on the run
they will contact Washington and get him and the kids

because he is a violator you will get custody of your kids

You can come to Washington, file a petition for temporary custody, and take them yourself, providing you have the proper documentation supporting your case.

My attorney filled for a temporary hearing before our final case. The judge ruled on it within a week. We had our final hearing 61 days ago and they have still not ruled.
