if the residents are responsible for the road,then it cannot be a public highway can it???

A road is any way other than a water way and includes any way that can be accessed by any means and includes any bridge over a way and any tunnel under a way.

In English, you have to be able to go from one place to another on foot or in a vehicle or on a horse. Thus a car park can be a way or a road if you access and egress by a different opening. If the same opening is for access and exit it is a car park and not a way or a road. It doesn't matter if you can leave by a different opening on foot, the 'way' or road is still complete.

A highway is a road.
A road is a highway to which the public have access on payment or otherwise and all bridges over which it passes.(Both legal definations in UK)
If the public have access to a road then yes it is a public highway and all aspects of road traffic law apply except you can keep a vehicle on it untaxed if it is not adopted and still privately owned

all private roads are unadopted.... the term adopted refers to the council taking over the responsibility of maintaining it....
As for public highways.... footpaths, bridle ways, byeways, pavements and roads are all considered the public highway...

An unadoted road is was it states. Whilst it is unadopted it belongs to the people whose houses are on that roadside, and they have to maintain it etc.,etc. When the Council adopt the road then all the responsibilities are transferred to them.

I live on a private road. The residents are responsible for its surfacing and upkeep, but it is a public right of way.

my understanding on unadopted roads is that if it needs re-surf icing the residents have to pay for that, but otherwise i think it is as a normal road for everything else.

the real scam is that maximum toll roads have been in simple terms meant to be tolls till ultimately they have been paid off. Then they switched that to "we would desire to repair and enhance them". presently maximum toll roads area a tax on interstate commerce which will pay for highway projects in regulation makers homestead cities. There funds does not guard that highway,it money different roads, pork.
