I have a 4 year old with serve Autism and left his father 3 years ago..since than then my ex has not cent a dime or even seen him. Although he is always writing me with threats through email. I have a great man that wants to adopt my son..so my question is should I just let him sign over his rigths or should I bring him to court and at least make him pay each month for my son if he does not want to do anything else, or should I just say his loss and get my man to adopt him..the thing is the Ex now wants to sign over his rights cause he dont want to have to ever pay for him. I dont think this is very fair considering even if he was paying each month he is still getting off scott free! any thoughts would be great!

Even if the ex does sign out his rights, he STILL will have to pay the child support. Absolutely take him to court and sue him for the child support AND for the back child support (all 3 years) that he owes you. You will be awarded that with no problem. You absolutely have to do it, because you owe it to your child. Your child cannot protect himself. So you have to do it for him.

You'd be better off with him completely out of the picture, but I agree with you, it's not fair that he gets off scott free. Make him pay. My son is almost 7 and I have never received anything from the father - (not even during the pregnancy!) If you are up to doing the whole court thing, go for it! I personally don't have the energy or the time to run after a car I'm never gonna catch, so just going at it alone.

If the man you are with now loves your son and you are confident that he will accept full responsibility of taking care of you and your son I would let him adopt your son, his real father is obviously a dead beat dad and doesn't deserve to see his son. Besides if you take him to court for child support he will always have something hold over your head causing you grief, I think you should let your man adopt and all of you move on with your lives and proved a good environment for you son. Just remember what goes around comes around, his real father will regret signing over his rights one day and it's something he will always have to deal with it!

Are you asking whats best for the scorned mother or your son?????

OF COURSE let this man adopt him.Bio dads loss.You have a man with the firtitude enough to say I will take this child,disabilities and all, love him as my own,claim legal and financial responsability for him and you have to ask???

I understand your angry at bio dad but good riddens to bad rubbish.And peaches to your prince.

You should do what is best for the child. What punishment you can give to your ex should not be in the picture.
