Inuyasha, Gundam and Evangelion are not classified as hentai even if they have sex scenes inserted in their show. The three animes you mentioned are just for teens. True hentai is just like a porn movie only it's animated.
As far as I know, hentai is legal since a lot of people don't know what it is actually.

As far as know of Hentai is legal in the US, I have seen it for sell at various stores(ie, like Sam Goody). I don't watch Hentai so don't really care to watch cartoon porn . . . or real porn for that matter.
The shows that you listed are not considered to be Hentai shows. While it true they might have a fan service moment now and then(possibly boarding on ecchi) but that's about it.

Hentai is legal in the US as long as you buy it on DVD from a store. It's categorized as animated pornography, which is still porn. The shows you mentioned are not considered hentai though
