1 1/2 years ago I was told that I had a tumor in my kidney and the dr was 99.9% + it was cancer. I was told I had to have part of my kidney removed. I went in for the surgery and ended up lossing my whole kidney. I was told after my surgery that the tumor was in my blood supply so they had to take the whole kidney. Then on the day I was discharged I was told by my dr that I didnt have a tumor. He made a mistake and removed a healthy kidney from me. Needless to say I feel like this is malpractice b/c the last test he did before my surgery didnt show a tumor so he ruled in inconclusive. My question is how much do you think a kidney is worth? I am in my 30's and have had alot of problems which can not be treated b/c dr says the meds will damage my remaining kidney. I live every day in pain now! & I just found out that my remaining kidney cant keep up and I will end up on dialysis needing a transplant. Should dr have to pay future med bills, pain, suffer, ect? What is a fair amt?

I guess my question really is if this was you.. I know money can not get my kidney back but I do not feel like I should have to keep paying in the future for a doctors mistake financially and phyically. What would you want if this happened to you?
And no I will never purchase a kidney so the I have 2 kidneys lets talk answer...give me a break!!! That isnt even remotely funny to me!!!

Oh I guess I should add...b4 the surgery I did ask for a biopsy and was told it wasnt needed he was 99.9% positive it was cancer. I dont know what he thought he saw on my MRI but he was wrong!!! Maybe it was a shadow since nothing showed up on my ultrasound.

There is no amount equal to the mistake this doctor made. He made a mistake that could possibly take years off of your life.
With that said, I will tell you how juries determine punitive damages. They basically estimate you worth... say for example, you make 50k per year and no longer can work. They would take 50k then multiply it by 30 (because you said you are in your 30s that would mean you have 30 years left of working). Then they estimate medical cost, factor in if you have children and a family... their suffrage, basic pain and suffering damages, etc...
Determining the actual amount is like an equation... for some reason, not many ppl know that. Also you have to be careful because the Republicans have been trying to cap medical lawsuits for years... I think they want it capped at 250k which is insane. In your case, I would say at least 10 million if not 20.

You to see a malpractice lawyer as soon as possible, You probably have a great case. There are statues of limitations in most states.I would value a kidney in the millions. You are so young to be going through this.A lawyer will tell you if you have a case or not by talking with you and checking the medical records.Malpractice is very hard to prove .It based on what a average doctor in their specialty would do in a given situation. Take care of your self.

Priceless..I do not believe in suing people but in this case it iseems like malpractise..he should have done a frozen section or test in the or. Or maybe more diagnostic teqhniques. I would seek a laywer as you, from now on are going to need very expensive medical treatment. Plus you should be on a kidney recipient list asap.

I couldn't just sit around and do nothing like my doctors suggested.
They didn't want me to do anything or to take herbs or herbal remedies, but I had to try something - they just wanted me to do dialysis!
This program allowed me to take control of my health. I went from Stage 4 to Stage 3 kidney disease.
It was easy to do and my BUN, creatinine and anemia are all in better ranges.

there really is no amount to put on the pain and suffering plus future pain and suffering why didn't they put the good kidney back in you if they found it good that would be one of my questions and even if you come up wih an amount they don't give you what it's worth believe me the pain and suffering nevers gets covered get a good lawyer.

Throwing out price amounts would be kind of pointless and ambiguous. "Fair" is also vague. However, you shouldn't have to pay for the consequences of malpractice, but that seems to happen much more often than it should.

There are institutions that arranged for free kidneys being donated by persons in case they met accidents. There are persons who sell their kidneys for more or less USD3,000.00.
