Yes you can. There is a precedent under the Primate Weiner act of 1984 that allows a monkey to be sued for punitive damages relating to the theft of hot dogs. You will also receive pain and suffering damages if you can prove your hot dog was slathered with mustard.

You shouldnt have been close enough that the monkey stole anything from you. Your case would be dismissed due to your stupidity.
