In most states, even if it is a step parent adoption, there would have to be a in home study. if a person has a felony, they will not do so. those are the requirements of an adoption regardless if the parents have signed over parental rights (your childs father would have to sign a consent to give up parental rights)

it varies from state to state. you would have to check with your county adoption agency to see what the policy is on step parent adoption. if they say no ask why and for documentation, then consult a lawyer to see what your other options are.

good luck.

You want your child to be adopted by a convicted felon?!! Any type of felon is bad news, your job is to protect your child from any thing or anyone that could harm him, you must be pretty desperate to be involved with someone like him,you are putting yourself and your child at risk.So when something happens don't say you were not warned.

The primary criteria are the ability to provide a safe, caring, permanent home; sufficient income to support a child; and good physical and mental health.

You may check the website for the eligibility to adopt a child

yes he can. The state will monitor you both for at least 4 months after you sign the adoption papers regardless to be sure you are "fit".

You see crack heads and pedaphiles can have chidren and raise families with no state overseers but when you have a felony record and are rehabilitated and would make fine parents they watch you. Pretty pathetic how our system works.

I wish you both all the best!!

and ummm..don't listen to the other replies..they hear Felon and assume the worst!! ; )

That sounds like a question for a lawyer. :-( The laws on this probably vary from state to state. If you can't afford to consult an attorney (who probably would charge you some minimum fee in the $200-300 range, guessing), then call your local law school and ask whether they have a law clinic. They may have qualifications for who can receive their services, and they may ask you a couple questions about income and expenses.

the child's real father may object but you should call a family lawyer or legal aid and ask. you never said what kind of felony but there is a big difference between felony DUI and murder.
