Everyone that I know that's been hired by Google has been under 40. How do they manage to discriminate in this way without getting into trouble, and why don't they think that behaving that way is "evil"?

Google has thousands of employees, so there is no way you know everyone hired there. The nature of their business is going to attract people under 40, but it is impossible for a company of their public stature to discriminate so blatently.

Yes. Do you know many people over 40 that have applied and meet the requirements to work at Google. You may only know of the people under 40, because those are the people you are around the most.
