at this point my money has not been deposited into my 401k, my employer says he does not have to deposit before april15

The rule was they had 90 days to transfer you contributions to your 401K but a few years ago it was changed to 30 days. Most companies credit your account a few weeks after your contribution. I would check with the department of labor or your Plans custodian and clarify the rules.It looks like the boses are holding your contributions to enrich themselves.

The employer cannot hold onto funds for any time period! I hope there is a misunderstanding on your part, but this does not sound good. I would suspend any future contributions to the 401K until this is resolved. That is, the money, YOUR hard earned cash, is put in an account earning whatever interest or dividends you should be earning from day one.
You really should go to whoever told that and ask what they actually mean and if it is true, where the #%&* is your money?
