NO NO NO NO. Cingular, or anyone else does not allow anything like that. Service has to be electronically activated between the cell phone and your service for it to work. That is the only way it can get a phone number to call or be called. You have to pay the full price, no freebies.

Your asking about buying a non-contracted open line cellphone for $40? The only thing you will find will be a refurbished phone for that price. You can try looking in craigslist. You can buy it directly from the user themselves. But really, you will get what you pay for. You are not obligated to buy phone from cingular, as long as the phone is an unlocked gsm (uses sim cards), you'll be able to use it with cingular. I've purchase phones from nokiausa.com and use them with cingular without any problems.

You can buy refurbished phones or go to www.phones.com. However, Cingular requires a plan with the purchase of a phone. The best thing to do is not buy one online at a site like www.phones.com at all. I have a friend with Cingular that wanted to replace her phone and she just went to WalMart and bought a Cingular go phone for $20 or so. The thing with Cingular is that there is a smart chip in the phone so you can't just replace it with any old phone. The best way to go is to buy a go phone. This is the website for WalMart and the link to the page with go phones:
http://www.walmart.com/search/search-ng.do?search_constraint=3944&search_query=go+phones&Continue.x=0&Continue.y=0&Continue=Find&ic=24_0

You may also find go phones at Radio Shack and Target, here are those websites, respectively:
www.radioshack.com
www.target.com
