in reference with my question before this, i was wondering since i never went to court or even met w/ the district attorney, is there any way i can sue the city and the police for falsely accusing me???
? they never showed me the check i supposively forged a signature on or anything.

My second day at work I get called to the human resources dept, my background check came back RED LIGHT RED LIGHT... felony charge. in 2002 i got arrested for forging a check or however u wanna call it. I was in jail for a day got bailed out, got a lawyer. they didnt arrest me til a year after "problem" (2001)maybe cause i was pregnant at the time i dont know. they never showed me the check i supposively wrote, never compared the signatures, never went to court, never met the DA or the guy who said it was me. we were (me, lawyer, DA) all to meet and go to the guy who said it was me to have him confirm it was me that cashed a forged check, ($56) and my bail was thousands. the DA said to just drop the case we never showed evidence nothing... all along it was my aunt who forged all this ****, her azz is in prison off and on for drugs and whatnot. i was in cell w/ her and she never said **** about it nothing. she fkn framed me.

Get a lawyer.

Get a statement from your aunt if possible (say there is money in it and then tell her to pound sand when it comes time for her to collect), file a defamation of character civil suit against the city and the police.

If your lawyer thinks you have a good case (this sounds like you might) he may even go after the district attorneys office. That would be his call.

Many lawyers will only take these types of cases if they think they can win. Remember, they are not doing this for the good of their health. If they feel you have a good shot, they may not charge you up front and take a percentage when they win.

Good luck with this. (maybe he may sue your work too if they acted inappropriately)

..Ok, I get it... try this... remind the human reasource office that an arrest is NOT a conviction... Michael Jackson was arrested for Child Molistation but was found not guilty... he will always have the arrest record... but that's the minor problem.
You will need to address the Clerk of the Court... get a "true copy attest" that your "case" was "nol-prossed" or vacated. That will legally show the World it was a non-issue... If they drag their feet... and Clerks usually do... make sure you've got all your "ducks in a row" and call the local TV station(s). They all have a viewer advocate attorney on staff and there is always an investigative reporter that just can't wait to stick his/her video cam in the DA's face and say...."Wa'Sup" with this...it won't cost you anything but your time... Sue the City?
You might need a good attorney for that one.....

An arrest is not a conviction. Ask HR if they found a conviction. They didn't and that's the end of that. If they still have a problem go see the Labor Board.

You are the best judge. To implicate the administration is costly exercise and you have to engage a good lawyer.

Ok were you charged with forgery? DId you go to court? Did you prove they falsely accused you? I would seek legal counselling
