Overtime pay is a federal law, not state. If you are in a covered job, and most are, then your employer must pay you time and a half for hours over 40. See http://www.dol.gov/esa/regs/compliance/whd/whdfs23.htm

You can call them at 1-866-4-USA-DOL
to report violations of this law.

Breaks and lunch periods are not required by federal law. If they are given, short breaks must be paid, but lunches don't have to be. Some states might have different laws on this.

Look on the itnernet for your local office of Labor, check to see what the requirements are to make a complaint. Lunch breaks are not paid, but the two 10 minute breaks you get for an 8 hour shift are on the clock.

Just call them, tell them what's happening and ask which form to fill out to file a complaint. Breaks are mandatory by law every 2-2.5 hours and a lunch. Over time...I don't know, may depend on the state but I think is also mandatory. Hope this helps.
