I think it is possible and probably very likely but if I were a juror I would still convict him anyway just to send a message to all the other white guys in our country taking advantage of poor filipinos!

I have had sex with women when they were drunk and so was I. Guess I'm a lucky one. She does not have to be drunk to allow a guy to have sex with her while 3 other guys look on. I have done in while 10 looked on with a perfectly sober girl.

I disagree with you on both your points.

1. Even if it is possible that your "the girl is framing the guy" theory did occur, I think it is highly unlikely in this case. These are the indisputable facts of the case. Remember the guy had "sex" with her in a van while 3 other dumbarse sailors looked on. She or any other woman (unless she's a porn actress) would have to be pretty drunk to allow that. According to Philippine law, if a man has sex with a woman while she is intoxicated and she subsequently charges rape--THAT IS RAPE, clear and simple.

2. Having said that, knowingly convicting a person just to "send a message" is inappropriate. In the US, such an act, especially when unaccompanied by evidence to support guilt of the accused, is unconstitutional. However, since I believe "pogi" Dan was guilty in this case based on the evidence--the message was sent anyways without having to resort to inpropriety.
