If two people need care for serious illness and the Dr's are willing to complete two seperate family medical leave forms, one for each family member does family medical leave allow 12 weeks per person, or would it still be 12 weeks of total unpaid leave? Thanks.

The law allows 12 weeks per year, regardless of the number of people who need care or how often the care is needed. The person could take all 12 weeks at once, or 60 individual days spread out over time. The years starts counting with the first day taken, so if it is spread out, they could possibly take one day off per week continuously. This is assuming that the employee is eligible for FMLA (has been employeed for at least one year and worked at least 1000 hours in the most recent 12 months), and the company is big enough that the law applies to them (at least 50 employees within a 100 mile radius).

Are you are asking if two people who both work for the same employer are asking for FMLA from the same employer? Are these two people going to be the people who are sick or the people who are caring for two family members who are ill?

If you are going to be giving care to family members, you need to read your company policy and handbook. The answer is that if you both work for the same employer then the 12 weeks job protected unpaid leave is shared between both of you. Unless your company has offered a more generous interpretation of the law and put in writing in the handbook or policy that you can each be given 12 weeks.

If you both are ill then you would be given up to 12 weeks of leave to recover from the illness.

Or are you saying that two people in the same family, work for different employers, need to be out of work for a serious illness? If that is your question then yes, you both would be given the amount of time your doctor says that you need to recover or be treated. It's not an automatic 12 weeks. If the doctor says 5 weeks, then it's five weeks.

If each person is employed, and each person has a seperate illness, then each person will get 12 weeks for leave.

I would think - if they're both being filed at the same time - it would just be 12 weeks (not per person). To be sure, ask your HR Dept. They could answer this for you pretty easily.

One person can only use 12 weeks per year of FMLA. Ask your personnel dept.

Unless your employer is very, very giving, I afraid you will only qualify for twelve weeks.
