OK I live in Indaian and I went out yesterday and was looking at a used van. I found one at a local Gates dealership and liked it alot. But I had a set of rims from my last van that I really wanted to put on and I didn't think they would fit so I turned down the van. The sales man told me to bring one of the rims in and they would check it out to make sure it fit if that was my only concern. So I did. Well I picked up the car today and the rims don't fit. The salesman assured me that they would fit and that I would have no problems with them. What are my options now? I put a downpayment down on the van and signed up for the financing but still owe on it I have had the car less than 4 hours now. Is there anything I can do are am I just screwed here?

You are an owner. You signed the papers, insurance was verified, and you drove off of the lot. There is no 3 day period to cancel the contract as long as you signed it at the dealership. If you stop payment on the check, the dealership will sue you in court and use the attorney that they have on retainer. HAPPY MOTORING !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Put a stop on the check you gave for the down payment. If it was not paid by check in most States you have 3 days to cancel a contract. It should say how long on the contract look for it and follow the procedure to the letter. Good luck

You need to tell the salesman that you're "revoking your acceptance of the van." He made a material representation to you about the van's suitability for a particular purpose, and you relied on his expertise in your purchase. Since the van is in fact not suitable, you are entitled to revoke, but you must do so within a reasonable period of time.

Do you have a witness? If you can prove he lied, then you may have remedy. If not, it would be your word against his.

Talk to an attorney about your odds of getting the contract canceled.
