Also do the laws change from state to state? If so, what is the law in NJ? Thanx to whoever answers this, because my friend is going through some problems in his marriage and needs some help.... Thanx again

No, marrying a citizen does not automatically make you a citizen under any circumstances. It is federal law so the law is the same in all states. The illegal spouse will have to return to his/her home country while waiting for the paperwork to be processed. The US citizen will have to file Form I-129 "Petition for Alien Fiance" if they are not married yet, or Form I-130 "Petition for Alien Relative" if they are already married. The fiance visa usually takes 6-9 months for approval and the spousal visa usually takes up to a year. Both forms are available at www.uscis.gov.

Marrying a US citizen makes you a naturalized citizen (provided you go through the process) and any children of the marriage are citizens as well. In most states if the marriage lasts for over 7 years you are free and clear but if the marriage dissolves before 7 years you are supposed to leave. After 9/11 immigration laws were changed drastically so im not 100% sure if this is the case anymore. Your friend should probably call the immigration office and ask.

I don't think marrying a citizen makes you a citizen automatically, but it probably helps speed up the process of applying for a citizenship if you do. I don't know the details sorry but check the CIS website.

Also, the laws definitely don't change from state to state regarding citizenship. They are made at the federal level and administered at the federal level. Residency perhaps yes, but not citizenship.

No, What do people on here not understand about illegal. If the guy is having problems with his wife and she is illegal, he can turn her in for deportation and vice versa. Also, there may be some question of the legality of the marriage, depending where they were married.

No I don't think so If they have children they can become citizens but the illegal still needs to get naturalized.It is the same in all states.

No that does not make you a citizen, because even if you marry an american you would still have to take a test to be considered legal.

No, quite the opposite. Since you were an illegal, your husband/wife will be unable to apply for your green card, which is the first step toward citizenship. You should discuss your options with Homeland Security (they now administer the old INS).

At one point it was true until maybe the early 80's now they'll send you back even tho you just had a kid here so no more marriges without love!!
