Classic lawyers answer: It depends. But seriously, this person seeks a legal answer, not a moral one.

I don't believe the term "infidelity" is grounds for divorce. From what I could find, "adultery" is considered one of the 13 grounds for divorce in Georgia. Adultery is defined as "intercourse" as far as I can find. My educated guess would be no, phone sex would not be grounds for divorce under Georgia law. The marriage could still be considered "irretrievably broken" which I assume is similar to "irreconcilable differences".
*I am not an attorney. A Georgia family law attorney is who you need to talk to.

Hmmm....so with some of the rationale I'm reading here....having phonesex with a girlfriend/boyfriend/spouse is wrong?

I don't think so!

Is viewing nudity a basis for infidelity?

Better not let Pietro Perugino, Sandro Botticelli, Domenico Ghirlandaio, Cosimo Rosselli, Luca Signorelli, Pinturicchio, Piero di Cosimo, Bartolomeo della Gatta, and Michelangelo Buonarroti know!

Some of these famous artists painted the nudes in the Sistine Chapel!

it depends on how betraid you feel. If you want a divorce, and you have no room for forgiveness and you think this will happen again, than nothing can stop you. File on the grounds of incompatibility. I am willing to bet it hurts just as bad no matter what kind of sex it is.

Definitely. The end result is the same. You're substituting your spouse for someone/something else. All forms of pornography are wrong and destructive. It is the cause for countless minds to be corrupted and countless marriages to end in failure. Porn addiction has risen to epidemic proportions, and there needs to be an outcry from those of us who seek to have a clean, decent society in which to raise our families!

No. It is considered masturbation. Ask Bill O'Reilly.
