Spider Man is far more powerful than Daredevil. DD has the senses, and human level agility and strength; Spider Man has superhuman agility and the strength to lift (press) ten tons. So, even assuming that Daredevil’s cane with the grappling hook and cable inside are equivalent to Spidey’s webs for swinging purposes, Spidey is still stronger. Peter will be able to trap Matt from a distance with the webbing and hogtie him and hang him upside down and use him for a speed bag.

Yes, it should be Spiderman, but whenever heroes do battle in the comics, the publishers don't want to hurt the feelings of any fans, so the result is always a draw, whether it's Fantastic Four vs. Spidey, or even Spidey vs. Thor, so Stan Lee's current crew would no doubt find some way to make it a draw or inconclusive, so as not to "offend" the Daredevil fans. The Hulk is one exception. No one messes with the Hulk. ;-)

I'm going to have to say Daredevil on this one, because of his ability to hook up with Jennifer Garner. Spider-Man realizes he could probably pummel DD into the ground, but thinking that all he has waiting for him back in the apartment is Kirsten Dunst he decides to leave and get a real job. :)
