If the parents are still married, yes they can. If divorced, it would depend on your court-ordered custody arrangement. If one parent had sole legal custody, then that parent could do whatever they please as long as it does no harm to the child. If there is a split legal custody agreement, then each parent would need written permission from the other to do this.

It is legal to do this. It makes no difference whether you are married or not. If you have concerns, you could speak to a solicitor to see if you'd be able to have a court order issued, demanding the other parent remove the picture from the website, but I'd imagine a court would only grant this if the circumstances proved that the child would come to some kind of harm for having the picture on the internet. An "it might happen" is not good enough. They would be looking to see if there was a specific threat to your child as a result of the picture being there.

I think that they can, a family member put their wedding photos on the internet with pictures of my children in some of them without asking, i was absolutely fuming!!
