Put the boots in craigslist and double your price to get your money back or you can do all those things everyone else suggested and have a bad headache.

Contacting the police will do nothing, especially if your in a different state. Hopefully you paid thru paypal and if you didnt you should from now on. Make sure you read his return policy correctly. Give the seller ample time to make things right, there is a possiblity hes away from the computer. All ways check the feedback. I have sold tons of stuff and bought tons of stuff, the majority of ppl buying and selling are just like you and me, if he has great feedback and alot of transactions then hes not gonna want to jeopordize (spelling) his rating. However if you just went off the deep end and didnt give him an appropriate amount of time before you left a negative response then he has no reason to make things right with you..... Hope that helps

First things first, it is your responsibility to read his exchange/refund policy on all items before you make a purchase.
Second, if you have NOT been able to contact him regarding an already PAID item. Action is required through Ebays fraud system. On the website they have forms to fill out regarding not receiving items and so forth.
Fill this form out so that justice can be served. They proceed to close his Ebay account OR put it on lock (depending on the circumstances i.e how much your item was, etc.) until he contacts you and a settlement or agreement on the item is made.
Ebay takes fraud and theft extremely serious and will take immediate action so that the consumer is greatly satisfied and not ripped off.
Do this as soon as possible as a delay will only worsen the situation and make it harder for you to receive any kind of exchange or refund.

Please tell me that you saved all of your receipts and can prove that you sent the boots back to the guy. All he has to do is to claim that he never received them.
He probably has proof that he sent the boots to you and that you received them. That will satisfy Ebay for the most part, unless this guy misrepresented the boots in his auction page. With clothes and footwear, I have noticed that when it comes to sizes, there are a lot of discrepencies in sizes. So it not not necesarily fraud just because the boots do not fit.
Your best bet is to keep trying to contact the guy and keep trying to contact Ebay about it. I do not think that Paypal can help you if you used them. You received the product and I would bet the guy can prove that. You can try contacting them though.
You may have messed up in sending the boots back before contacting the guy.

You need to file a dispute through ebay security and they will follow up with the seller and help you resolve it.

contact the supervisor of ebay, also mayeb if you payed alot get the police invovled because its considered stealing. GOOD LUCKY! hurry make ur decision fast or it may be to late to get ur money back!
