I have a friend that believes that if an American smokes a Cuban cigar while in living/visiting in Canada they can be prosecuted in the USA. I believe this to be untrue.

When you are in Canada you are subject to Canadian Laws.

Just like a Canadian can be subjected to the death penalty if they commit a murder in a US state that has the death penalty.

Just like I as a Canadian can go to Amsterdam and smoke pot and not be prosecuted when I return to Canada.

You are correct. It's untrue. It is NOT illegal for an American to smoke a Cuban cigar while in Canada. I was in Saudi Arabia in 1995 and bought them all the time, smoking them anytime I wanted.

It is illegal to import Cuban cigars to the United States; however, it is not illegal to possess or smoke them, even in the United States. The way around the law is to travel to Canada and buy them there, then bring them across the border when you return home. As long as you're not bringing them back for resale, you're OK.

what are you gonna use as proof for the conviction?. the smoke?

you cannot import Cuban cigars into US. But what ever you do outside the country is your business. Canada is out of US' jurisdiction

They cannot be prosecuted. Although they should be, Cubans suck. Dominican baby, all the way.

No-- when in Canada, it's Canada's laws. The government could give a crap about what a US citizen does in another country as it's the foreign country's jurisdiction. (Unless, of course, it's a US citizen running from the US for some reason.)
