Look, that depends on where you live, but some things to consider:
1. If you sue the school are you prepared to change schools? Maybe pay tuition? Take a chance another school will take him? and if it is the city there are ways city hall can get you back.
2. What was you son doing? Can you prove he wasn't goofing around? .
3.How old is your son? Just a little kid, or a big boy? You know what they told me when I fell down and got hurt? Be a big boy and suck it up. Don't be such a big baby.
4.You want your son to be a big baby? You want him to get the idea he can sue anytime something bad happens to him? What if you did something to upset him? Would he later sue you?
Finally, if you sue the school, or city your local taxes go up. Are you willing to punish innocent people just because you kid might be clumsy?

I'm not sure the school or the city made the ice. You need to find the party responsible for putting ice on the sidewalk.
What negligence is there by the school or by the city? It isn't as if they were out there with hoses deliberately creating a dangerously icy condition on purpose.
Imagine that you live in a house, and someone walks by and slips on the ice on the sidewalk outside your house, and then asks you to pay for their hospital bill. Would you find that to be a logical course of action? If so, tell me your address.

It is school property. You can sue Newton for the Law of Gravity if you want. People always trying to blame someone else for their situations.
You'd only get any money if it was some major negligence on the schools part that he slipped. If he's not marred for life why would you sue. Just get the school to see if they'd pay the medical bills.
Too many people out for a free ride.

i know your mad. your kid fell and got hurt. you fell down often when you were a little boy right? did your mommy and daddy sue? i'm sure they didn't.
if you sue the school know that some of the money they use the fight you could be going to buying new textbooks, building a new playground, getting new books and computer software for the school library, or fixing that evil sidewalk.
talk to a teacher and tell him your worried about the safety of the school children and you'd like to see the sidewalk fixed. if the sidewalk is fine and you child just fell down. put some ice on his head and teach him how to walk.

It would be considered school property, and if your son was still at school, or just coming out of or going in to, then they would be the party liable.
HOWEVER.......Its a fall. If you think they were intentionally negligent in some manner, then sure, sue. But, unless there was some true negligence, get over it. Kids fall. They break things. They move on in life.
If you want to look at it by liability, then why were you not there to protect your child from falling by holding his hand while walking in to school. It would appear that you did not take due diligence to protect him, and therefore, there is no party liable.

They are both culpable if the walk was dangerous to pedestrians in any way. The school has the obligation to maintain the walk in winter and report any damage to the city. The city on the other hand has the responsibility to maintain damage control where the school is incapable of mending the problem. A problem like the concrete has cracked and risen due to frost heave. But ice and snow on the walk is to be taken care of by the school. This is how it works where I live. How it works in your community may be different, check the bylaws.

Boys fall down all the time and get nasty knots on their foreheads. To sue is just an excuse to make a few bucks off of it, isn't it?
Next time, tell your kid to throw himself under a bus. You'd make a lot more and be able to take that European vacation this year.....

Get over yourself. Kids slip and fall and it isn't anyone's fault.
Don't make this already litigious country even worse.
Don't forget the school and the city (if public, all the same) have MUCH deeper pockets than you do to fight this.
If you're concerned about your kid slipping in ice, don't live in an area that gets that cold! Of course, then you'd be suing who-knows-what for sunny damages.

Sue the school? are you kidding me?? I would complain to the Town School Department. - Maybe to the Superintendent of schools. If every parent that had a child who slipped and fell on school property sued the school dept, imagine how property taxes would sky rocket????

why in the world would you even think of suing anybody? who's fault was it that he fell? did the school or the city push him of the sidewalk? If someones kid pushed him and he fell, find out who the kid's parents are and speak to them. I would love to be the judge handling your case if you decide to sue...
