My friend drives a 93 integra and the lights are kind of funny looking...anyways he has always driven with his headlights and fog lights on. He got pulled over for having his high beams on (which he didn't) and told the officer that it was his fog lights, not his brights. The cop told him that it was illegal, and then gave him a ticket for failure to dim headlights into oncoming traffic. First of all is it really illegal to drive with fog lights on (since I see hundreds of cars every day with fog lights on) and is this cop trying to skrew my friend, and catch him in not knowing his rights...which I don't want to let happen. Should he plead guilty and pay it, or fight it?

It is illegal to drive in many states with fog lights on. And are they stock foglights or aftermarket? Read the light, 90% of them say "not for highway use". And your friend should go to a good mechanic and have his headlights and foglights realigned....they may be aimed improperly appearing to be highbeams....Take that receipt to court and he should get off.

It is kind of illegal to drive with your fog lights on because they should be mostly used for when you can see at night or in a fog. The cop was only doing his job. As for all the other people, they are just as wrong. Sometimes the cops are just lazy and don't feel like doing their job so the other people who do the wrong thing and get away with it. I think your friend might feel much better if he just pays for the ticket that way he can have it in his past and gone.

No it is not illegal to drive with your fog lights, or day lights. However, when you are driving during dusk or dawn, driving with you high-beam lights on with on coming traffic is illegal. Driver eyes are effected when high-beam lights hit their eyes. This can cause accidents which may lead to someones death. It is the same as someone directing a bright flash light in your eyes in the dark.

In Oklahoma, it is illegal to drive with your foglights on when it is not foggy. I have been stopped for it before by the Highway Patrol.

Yes, just because a lot of people do it, doesn't make it right. How many people speed, just a few mph over the limit? Even 1 mph is illegal.
The cop isn't trying to screw your friend. He's trying to protect the right of others by not being blinded by your selfish friend.
He should fight it. That way a judge can jump all over his stupid as s too.
