My friend drives a 93 integra and the lights are kind of funny looking...anyways he has always driven with his headlights and fog lights on. He got pulled over for having his high beams on (which he didn't) and told the officer that it was his fog lights, not his brights. The cop told him that it was illegal, and then gave him a ticket for failure to dim headlights into oncoming traffic. First of all is it really illegal to drive with fog lights on (since I see hundreds of cars every day with fog lights on) and is this cop trying to skrew my friend, and catch him in not knowing his rights...which I don't want to let happen. Should he plead guilty and pay it, or fight it?

Most states have similar law on this matter, stating plainly that the "Fog Lights" or "Auxilary" lighting systems must be used in the same manner as High Beams. This is to ensure the safety of all individuals on the road, as they may cause a distraction to other drivers. I am sure the police officer is in the right, had he not been, he would not have issued the citation for the infraction. People commonly mistake the law for specifing the Highbeams as defined by the factory installed high beams, but most state law lists that "any and all auxilary lighting systems, including, but not limmited to 'Fog Lights', 'Off-Road Flood Lights' and others of a similar nature must be used in the same manner as the factory installed High beams"

I would suggest that your friend uses this as a learning lesson and does not contienue to use his fog lights while driving unless it is a situation that requires the use of such lighting systems. Good Luck, I hope this helps.

the same thing happened to my boyfriend last year.
Its no illegeal to drive with fog lights on but its is illegeal to have really bright lights..you just have to go to court and explain to the judge that the fog lights were the wrong watts and you didnt realize they were on...GOOD LUCK!
