Can someone (including opposite sex relationships) be considered a "legal spouse" without marriage?

No- a couple must have a valid marriage license to be a spouse.

Same sex couples are NOT spouses. They can be registered as domestic partners though.

They might not be termed "spouse," but they are entitled to a lot of the same rights and protections as one.
