You have temp now. So get yourself an attorney and file for a motion for full physical custody. You should also try to make it a point that you do not want visits to the moms house to take place when step dad is around. You will probably win on all the things you said above. It is not a safe environment for the child. Has the step dad been rehabilitated at all or in the works on it? If so this could help them a little when it comes to having visits with your son. I am really not understanding your question, the State should represent you in a case like this, call your local child support agency they should be able to guide you. In preparing for an 8 year old to live with you are you asking about schooling or what? If your the biological Mom, don't you know what to do? Call Human Resources , or child protective services in your town, they will be more than happy to represent you, probably at no cost, its all about the child, and once you've filed a report with child protective services, it never goes away. Check out the web site that I gave you and set the boys room up, because child protective services will check you out as well, every thing on that web site is free, you may need to post what you need to get the child set up. Find out about the schools in your neighborhood, get him into a routine. Stand your guns with this child, remember that you are in charge, he could be carrying some bad luggage with him, you have to correct him and let him know that he has to abide by the house rules. For one talk to your son openly and remember to always comunicate with him. Secondly find yourself a good family lawyer dealing with custody issues(if you live in the Boston area Greater Boston Legal Services...they have a unit specializing in family issues). Discuss your options with your attorney. I'm sure there's a social worker involved, talk to him/her about ways you can make sure you meet their standards for providing the best possible environment for your son. It will go a long way toward demonstrating that you have your child's best interests at heart. While your ex may have made poor decisions concerning her choice of mate, do not badmouth her to your son. He will decide for himself how he should feel about her.
Talk to your attorney and see if this makes sense to him. Discuss the procedure and time-line with him, then put your plan into action.

You need to go to the public records of all the counties this person lived in/got in trouble in and pull up his files and print them and take them to your lawyer or have your lawyer do it for you. I am going through the same thing right now trying to get custody of my step-daughter.

Present your case to family court. Try to avoid mud slinging his mom, though, he won't appreciate it.
Your ex'es hubby's record will speak for itself, as will yours. Talk to your lawyer, share your concerns. Your lawyer may know the law better than you do and could know loopholes. As long as you present yourself to be loving and willing to share access (don't threaten to cut mom out of his life...), the judge may see you as a better option.
By the way, the courts will listen to the opinion of children 12 years of age and older. I know your son is only 8, but if he is mature, and wishes to live with you, the court may take that into consideration.

Document EVERYTHING...get a good lawyer. Also, get your child involved in counseling. The court looks very highly on this. Attorneys can be expensive but they are worth it in the long run.

i don't think you have a problem there. with the step father having a pretty bad criminal record, i very seriously doubt they will give him custody. he will be lucky to get unsupervised visitation rights.
