At a party last weekend i got a little drunk and made out with my best friend. Im not a lesbian i was just having fun.This kid Billy taped it on his camera and says he's going to post it on his myspace. Is there anything that says its illegal to post someone on the internet without permission?

He cannot post it without your consent, as you are the subject of the video.

I at least hope the kissing part was fun.

Assuming that you're over 17 (or 18, depending on state)...

It is legal to post this, as long as it's for free. Commercial use requires permission.

The defense for defamation is the truth. In this case, you actually did the act. So, you cannot bring a defamation suit.

Looks like you'd better start thinking up some witty comments to make to people who see this.

By the way, if you're under 21 and there's evidence of you drinking, you could find yourself in further trouble. Doubtful, but this means that you should definitely not make a fuss over the video.

I agree with the answerer above.

If you are under 18 tell him that if he doesn't give you the video you will go the police also tell him:

If he doesn't return it he could be charged with possession of child pornography.

If he posts it could be charged with:

1- Possession of child pornography;
2- Making child pornography;
3- Distribution of child pornography.

No's 2 and 3 are very serious offences.

It is actually unlikely he would get charged, unless there is nudity too, but that'd probably be enough to scare him into giving it to you.

Come to think of it....I agree with the first answerer too. Watch the booze sweetie.

a LITTLE drunk?

when you are in a PUBLIC place and doing things - people can tape you all they want and post it where ever they want - because the law sees it as " well you were doing it public for people to see - so why cant he tape it ? " nowww if you were in the privacy of your home - of coarse laws would protect you. Bottom line - stop getting drunk - im sorry but you deserve what you get.

You have rights.If he post on my space then you can press charges. Think about is its the same situation when those girls jumped that other girl. You can contact my space and give them his screen name and they can kick him off.

This is why it's a good idea not to get drunk.
