Did you go through a formal legal separation that specified what bills were who's responsiblity? If you don't have a legal document stating who's responsible for what, you might be screwed. Before the divorce can be final all these bills will have to be worked through and decided who is paying what. Yep, it's going to go against your credit (if it's a joint card) and spousy doesn't pay it. If you shared 50/50 custody of your kids then half their debt was already paid for by you by having the kids 50% of the time.

in our state if there is no legal separation filed with the courts then there is no separation of debt.we also have to run a ad in as many local newspapers the we will no longer be responsible for any debts other then our own after we file the separation papers.banks and credit card companies would go bankrupt if all it took to break away from debt was breaking away from the partner we had when the dept was acquired

If you can prove you were Legally separated at the time, your spouse used the Credit card, and you did NOT use it at all, It is possible with a little bit of legal advice that you can get yourself cleared of that Bill.

I believe your only responsible if your name is on the account .
You mentoined "joint credit cards opened in there name unknowwn to you " . If your name is on that and you didnt sign it , you could take legal action .

technically, yes it is your debt as well, since it is in your name I would go ahead and pay on it so that your credit is not ruined. Go to the police station and file fraud charges, get to a lawyer and start divorce proceedings that way the judge can order the account closed. You can always go after the spouse later in civil court for damages, if they are not addressed in your divorce.

Joint card; joint debt. Only chance you have is to file a fraud charge against him, as it is illegal to open a card in someone else's name without their approval; or try and resolve the amounts and issues in the divorce settlement. Check with the atty handling it.

once you are legally separated any debt incurred after that date would be you spuoses resposibility-however if you have any joint accounts I would cancel them ASAP
