I was the victim of a hit and run accident yesterday. My car was side-swiped by the trailer of an 18 wheeler that didn't stop after it hit my car. The only information I have about the truck involved is that it was white. I wasn't injured but my car has major damage. I immediately called 911 and waited at the scene for 2 hours without response from any law enforcement agency. I then went directly to the State trooper barracks that was 1 mile from the scene of the accident and filed an accident report. My question is do I have grounds for a civil suit against the law enforcement agency that didn't respond to the scene of the accident to assist me and try to locate the truck that struck my car?

No, you have no case against the law enforcement agency.

They only have a duty to take reasonable measures to assist you. Their response also depends on what other incidents are occurring at the time. Unfortunately, car accidents are low priority for law enforcement.

Nowhere is it expected that they will be on the scene seconds after the accident or that they will start a manhunt for this white truck that sideswiped you.

I'm sorry, but telling them the truck that you was white is like telling them the sky is blue.

No. Your action would be against the truck....which will be difficult as you didn't get any information at the time of the accident.

You must realize that the police must prioritize the 911 calls. Yours was not an emergency; no one was hurt of killed..... They must respond to emergencies first.

Don't be too quick to come down on the police...they have a tough enough job. Accidents like yours happen every day...suck it up and have your insurance company repair the car. You must learn that there are always disappointments in life..you must learn to accept them and not blame everyone...

i think that it was just not your lucky day. Next time you should be more careful on the road and i know that truck drivers has no respect on the roads. Here in south africa as well. It will be real hard to locate that truck cuz there is alot of white trucks all over your country and secondly you didn't see the drivers face.

Probably not....check your local & state statutes. But, because you weren't hurt and the incident wasn't life threatening, even tho it was bad to you, chances are you don't have a chance.

your best bet you been to have gotten the license plate becuase, you could of sued them
