lets say the people living there do know that the person in charge(ketua kampong) is not the rightful owner(like the middleman).. and they are aware that the legal owners have the proper documents to take back the land..
also note the kampong people never paid any sort of rent to the legal owner.

ok the situation is like
Main Owner -> Caretaker(not related to the main owner) -> Ketua Kampong -> the village people
Now the caretaker(we have no idea if he takes any money from the people-coz he said he never) kinda wants to take over the land from the ketua kampong but not able to do so because he has no legal rights plus waris my family is still living,..they way that caretaker is handling things is like he is making it his own land!!!(heard rumours about him selling some piece)
so main owner feel the need to take action before things get worse.. so mabye retaking back the land is one of the options.

As long as u have the legal documents to claim your land, u have the legal right to take it back.
Legally, if u erect a house or place an item on someone elses land/property, it's considered trespassing and you can be sued. On top of that, if somehow u caused damage to the land (erecting structures like houses or chicken coop), the rightful owner can make u pay some compensation.
In your case shayna, those middlemen and those kampung folks living in your land have no right to sell that land. To be able to sell a property or land, you must be a rightful owner of the subject matter, meaning even if the land was sold u can still take it back and make that transaction void.
Go to pejabat tanah with those legal documents/deeds and clarify the matter. Be ready to answer questions like have u been paying tax for your land and such.

Why call it evil? If the land is owned by someone, then it's that person's . Sometimes, because the rightful owners are not living in Malaysia, and has lots of respect for the people, and not really in need of the money, they (these owners) might choose to return the land to the common people. It all boils down to how this particular owner looks at this piece of land. A goose which lays golden eggs, a piece of hereditary.....

It is absolutely legal for the rightful owners to take back the land since no rent have been paid. However, if there are any sort of agreement between the rightful owners and the tenants/middleman that they can stay as long as they like, than those people who has been staying there can ask for compensation for moving out.

It always depends on who is the rightful owner on the land you've mentioned..if its belong to your ancestors..you need to know whether if your greatgrandparents have allocate the ownership of those lands to whoever they are intend to give..
but to exactly answer your question..yeah..i truly agree with you as the other party have no right whatsoever to suddenly claiming the ownership of the land..the rightful owner must have a solid legal documents to proof and possibly to 'kaveat' their land..this is to safe guard their property..
i have experience this before..imagine that you have a property and suddenly out from know where someone which you really despise came and claim that he has also have right to my property???which is in legal matter its stated clearly that he wont get any single cent out of it..and yet..the fellar still telling that he want his cut..gila..

since this is kampung issue, i guess u dont have any proper documents stating ur ancestors own the land. and the caretaker also dont have the right to do so. kampung issue is usually resolved by people voices. get votes to outcast the caretaker.

The rightful owner should be blamed cause he/she did'nt do anything to his/her land all this time. And now suddenly he/she wants to take it back just like that..i think that is bad. Not evil but bad
