Your question does not relate to any Canadian or provincial legislation.
Just like any merchant, a gas station can be "Sold Out" of a specific product and they are not obliged to substitute. They are just telling that they don't have what you want right now but we do have this at a higher price. The decision to buy it is yours.
If what you said were the case, I would be waiting for the car dealership to run out of Chevrolets so they would have to sell me a Cadillac at the Chev price.

The gas station cannot sell a premium gas at a lower rate when the regular gas is out of order because their business will be on the losing end. Customers cannot demand for a lower price because the shortage is not the fault of the owner but the delivery company.

The gas station must by law place a sign that says "out of regular" but Gas stations do not always follow the law. such as reports of "watered down gas", and faulty meter readings, plus they also change the price many times in one day, when the price per barrel is set when the stock market closes, so its the Gas station owners, and the refineries that are to blame for unethical price fluctuation.
